Hi everyone,
I got my labor approved under perm on Sept 11th however I have not filed for I140 as yet. This is because of employer making n reasons to file the same. Anyways, if the 45 day rule comes into play - does my labor get cancelled as it has been more than 45 days since it has been approved or does the 45 day period start after April 26th. How many of you think this rule will come out. I hope it does. That way employers will have no choice but to file I 140. A lot of employers now adays are stalling filing the same since they fear the employee will move. Am I the only one facing the same problem or are there others as well?

I organized a Conf Call for SoCal members last friday, but only Pappu (Admin/Moderator) turned-up. It was disappointing to see that few people care to participate. I did get couple of messages from folks who could not make it. I appreciate their response.

You have to wait untill Oct 1st to work.
But you can apply for h1 visa 6 months before ie April 1st. So start applying for H1 immediatly as the cap for H1 will be reached very soon (may be in 1 week)

Check with attorney if they have they filled other EB2 petitions in this fashion and got approval? I dont think you can do much if both attorney and HR want to process perm in a certain way

My wife renewed her license showing 485 receipt as the evidence. I think the PA DMV Manual says that if your AOS application is in progress , You can renew your license for 1 year. We did not need to show the EAD.

It is really tough to get EB2 without work experience. Requiring a foreign langauge usually does not qualify for EB2 category automatically.

i enetered US on h4 visa in sept. 2007. got h1b and started working on h1 in october 2008. was laid off in nov 2009 and my husband promptly filed my h4 and got approval in march this year. now another employer has filed for my h1b visa. do I need to wait for h1b approval notice since I am on h4 visa or can I start working as soon as the company receives the receipt notice?thanks for your answers.

My wife has already gone to the consulate and got her stamping. So she is out of the loop, its only me who needs the stamp.
To put my question in a different way:
Will the consulate cancel/stops/statusquo my wifes H4 visa as the H1B is in "Admin Processing"?

I don't think there is any site in this world which can give US visa status after the interview.
Interviews are conducted by govt officials and not just other websites, but the consulate offices are also not maintaining any sites to track the status. I am 99% confident about this.;)

You have answered your own question. This immunization protects you from most forms of TB and causes you to have a positive skin test since you have antibodies in your system to attack the PPD test ingredients when they are put under your skin.
Not sure why you are worried about it? This is no different from the other vaccinations you were given as a child that you had no choice on.
I am from the UK and every child was given the BCG vaccine for decades, normal course of growing up.

I am also renewing the EADs but the concern is more on what if the renewals are not approved by 9/2010. Looks like your answer is they are still legal (AOS)

Hello everybody,
My lawyer mailed me photocopy of I-485 form ,EAD application and AP form
which she filed last month. I saw that my lawyer has enter my old address (Michigen ) by mistake. My current address is in Illinois. The G328 form mentions the Illinois address as my present address. I had already send my AR-11 mentioning my Illinois address as my new address before my I-485 was filed.
My worry is will the finger print notice,EAD, will come to Michigen address or Illinois address
Pls guide what should I do to change the address on 485 to my new address..

If the employer agrees not to revoke the 140, Can I change the employer after getting EAD. 485 application is pending but less than 180 days.

I had applied for my wife through paper and they did not ask for her fingerprints. I had applied for mine through efiling and they did ask for fingerprints. I was not in town on the day that they had asked me to be at the service center. So I requested a later date. Lo and behold one fine day I got my EAD approved without any fingerprints. Don't ask my how it was approved but that is the case.
