Isn't the GC process independent of what you do now. It is petition for future employment. That is, at the time of adjudication, the employer should still be willing to offer the same position to me or the current employer should provide a letter indicating the responsibilites in the current job are the same as in the original petition.
If I take another job on H-1B, how does the AC21 rule come into play when I am not on EAD?
Also, if there any rule that you have to stay in the current job responsibilities for 6 months after getting GC?

Hello Guys,
I lost my job last week and we have decided to return back to India.
Filed 2 times for GC and got stalled for some reason or another. I am on my 7th year extension. We decided to go back due to frustrtion of Immi. policies and other personel reasons.
I was one of the first 500 members in immigrationvoice.com.(but was not so actively involved)
Still remember those days in 2005, I was an active member of another website callled us immigration america travel news at isnamerica.org (http://www.isnamerica.org). (new members might not know abt this site)
I was very critical of IV during it was formed, but became a member after I got a call from one of the founders of IV.(dont remember who?)

Please advice.
The H1-stamp on my passport has expired in 2005. I have an approval for H1 till 2010
I will be filing 485 / EAD / AP on July 1st in EB2 category.
Since the 485 approvals are 2-3 years away
Is it possible to go out of the country for H-1 B stamping or if the EAD/AP gets approved i must go on to that status.
H1 is preferable since i do not have to worry about work authorization
whereas with EAD since it expires in 1 year , i will have to keep my fingers crossed and not work till the next EAD gets approved ( after june next year )

My friend who is currently working for a IT consulting firm has applied for H1B transfer to a direct hire position with a leading healthcare co. He is currently maintaining H1B status, working and getting paid.
He came to US originally on L1B in 2005 and applied for a L1 to H1B transfer (with change of status) which was approved in Oct 2006. The problem - he continued working for the L1B firm till Dec 06 and then joined the H1B employer. At that time, he did not know that he was supposed to start working for H1B employer right from Oct 2006 when the COS was approved. The lawyer who filed the application advised him that it was OK to continue working for the L1B firm till Dec. He has subsequently maintained H1B status at all times and has even travelled out of the country, got H1B stamped etc. without any issue.
Questions:
- Was he out of status for 2 months (Oct to Dec 2006) when he continued working for the L1 firm even after COS approval?
- Could this be a problem for the H1B transfer that has been currently applied for. Does USCIS check only whether the individual is currently maintaining H1B status, or do they go back and look for past periods also to determine status violations?
- Even if USCIS determines he had violated his status, is there any provision (like 245k) which protects him for the current H1B transfer, since the potential out of status period was only 2 months?

I am also in the same boat as you and my attorney has sent my Labor ETA 750 to DOL for changing the box 15. It is good to change it now at Labor stage as there is quite lot rejection at I140 stage if your degree is 3 years..so it is better to have it ammended at Labor stage.
I would say all those who are waiting on Labor with 3 Years degree should make sure that your Labor states that it a "combination" else you will be trouble.

First of all please forgive me for creating a new thread. I am just trying to see whether any one in the same boat and what it could be.
I just found soft luds on my previous H1B which was approbed in 2006 Feb and I-140 which was approved in Dec - 2006 (I-140 lud was after one week of H1B Luf change). I wonder what it could be? I know there is no logic and it is hard to predict what it might be. May be some standard updates as some one suggested. But these two did not change in years.
Any way, any one in the same boat?

I agree with the post above.
I think the best option he has is to speak with the CBP officer at the port of entry and explain him the situation: that he wanted to use automatic visa revalidation and by mistake he surrendered I 94. Hopefully he will issue a new I 94 for him. But more likely he will ask him to go to the consulate and get the new stamp.
What he should NOT do is: to enter on the attached I 94 on H1 visa extension approval (the reason is technical: usually the I 94 that comes attached with change of status has the SAME number as your old I 94 attached to passport; so for practical pusposes, he has surrender both his I 94s). If he now enters with the I94 attached with H1 approval, (and as that is already cancelled when he surrendered other I 94), he will be considered present illegally. This would have much worse consequencies than to wait in Torronto and get the visa stamped.

My brother is finishing his BDS in India this year. I am planning to bring him to US for the studies in USA. Could you please help me on what he needs to do to enter here and are there any hurdles. I am new to USA too so don't know much about the ways so trying to find out. All I heard is unlike engineering its difficult to come for medical studies to USA.

fionaapple20: Safest and clean route is to find an another employer and transfer H1B. Make sure your current employer does not revoke your 140, in case if its not approved. Additionally, it is highly recommended to invoke AC21 after your 140 is approved and 180 days passed.

If its few months of outside work.. should be fine... But you can't and should not just leave and work outside until you get GC.. May work, but chances are rare.. So risk is up to you to take and decide...

Any suggestion whether to switch attorney after using AC21 and moving to new company?
If you have good relationship/communication with your previous attorney, it is not recomended to change, as it is a additional work for uscis, that they may not like it. The new G-28 may not properly attached, uscis may not update the information ect may cuase you unrest. As long as possible, avoid contact with uscis, unless they asked to do as they are heavily backlogged with all application.
