I got a response for the SR made through Infopass saying that there is lot of work load in NSC so there have extended the processing of my I-485. IN the SR we have asked about the incorrect EB classification and wanted to know the current EB category. This shows that SR responses are most of the times useless. I made a infopass appointment (3rd visit in 1 week) and was indeed able to find that USCIS screwed up my EB classification. Now I am trying all avenues to get this corrected. Because of USCIS's mistake I Lost multiple approval opportunities in last 2 years went dates became current for EB2.
My I-140 clearly shows that it's approved in Eb2 adv Degrees or Exceptional ability category. My lawyer and Employer both have agreed that USCIS has made mistake. in Infopass they created an SR last week with regards to this and there is no response.

O*Net Online website has a useful tool to learn which other occupations relate to one's present occupation. Simply enter your O*Net/SOC code and go to "Related Occupations".
This may prove useful for inidividuals searching for jobs in "similar" occupations. Altough this information can be very handy it goes without saying that every case is different and one should not solely rely on this.

I am having some trouble understanding it. In 2010, they have only allocated 2400 visas to China EB3? That is a wastage of 3300-2400 = 900 visas ??
Not necessarily, this data is 3 months old I think. The last quarter allocations could have closed the gap.

Focus on the core issues (if you care), not on extraneous stuff. For petes sake, it is already approved, seems like most of us are only focussed on our own backs or riding on others.

this journey for me started 5 years ago, at this stage I'll take whatever piece of information, trend or experience I can get to better understand the process.
lets be honest, USCIS have been less than helpful in providing updates and many lawyers are as lost as we are
so I'll take whatever extraneous stuff I can get, not just to understand my case, but to see the trends with other people too

Folks here is the deal.
A lot of people are getting denials and forced to apply for MOTIC. It could be various factors.
As USCIS is doing background processing on cases trying to preprocess cases even if priority dates are not current there seems to be cases where people are getting denials when RFEs are supposed to be sent.
Things that trigger a denial in a straightforward case
(1) July 2007 filers - those who filed in August 2007 (the filing was open till August 17th)
(2) Immigration medicals - if not included - USCIS sent a circular that people can apply without medicals and will be later requested via RFE
(3) AC21 - employer revoke 140
None of the above should trigger a denial but looks like they are triggering a denial.
It could be that there is pressure to reduce backlog as economy is not good and we all know that immigrants are scapegoats in such situations.
It could also be a training issue for new staff.
As they are trying tom speed up processing - all they might be doing is - look at the file - if something is missing or something is not right - immediately deny the case.
MTRs should resolve these cases but it is a waste of money and unnecessary tension.

My employer is not giving me copy of Labour certificate. I know all numbers. Do I need a copy of AC21
I'm not an expert but thru these forums got the understanding that you dont need a copy of labor cert (if you have its even better). Most employers dont share that anyway - except maybe the desi consulting companies (we may not like them but sometimes for GC purposes I feel that they are ideal companies - atleast they understand what we are talking about).
Regarding I140 - I am not sure but saw conficting opinions - some thought its OK even without a copy of this one too but some suggested its better to get one. In any case having the case numbers would help I guess.

I am a July 2nd filer with a priority date of July29,2004 (EB2-I). I did not receive biometric appointment so far. I had a infopass appointment today, and the immigration officer checked the system and generated the FP appointment and I went straight to ASC after Infopass and got my FP done. Officer also confirmed that my name check is cleared last month but had no idea why my file is not assigned to an Immigration officer. She said there are no apparent issues that she can see in the system with my application and she opened a SR for them to look in to my file.

Getting CIR passed (or even bring back to attention) may not be that easy. These types of raids are increasing and many people are thinking that goverment is doing something about an important problem.
Bringing back CIR and passing it will entirely depend on the political moves of the two parties and important players. Any raids and resulting street rallies are not going to do anything. If you want proof just see last years momentum and what happened eventually.
This year's political composition was different. Anti-immigrant majority politicians and do-nothing attitude was the cause of inaction.
Next year the political composition is widely acknowledged to be pro immigration. So the results are likely to be different.

Hi,
Unfortunatly , i lost my wallet contains EAD.
problem is , how much fees should i pay for the replacement card.
we filed 485 on july 2007 visa bulletin no. 107
and we (mine was H4) got EAD on oct 2007. i have a scanned copy of it.
I am confused whether to pay 180$ as per july visa bulletin no. 107 or
have to pay the current fees 340$.
2. If i pay as per new feese, still do i get the same 1 year validity card.
please help me for this

If you don't have a job on H1-B then you are not in legal status within this country. This may come back to haunt you during future 485 processing and approval. That's where an EAD is good in that it allows you to remain in legal status even when you don't have a job for a certain period of time.
ok got it. so its better to jump on EAD whenver you feel the fear of being jobless for a long time. that way no problem if jobless for certain time.
only con is if something wrong happens to 485, we are screwed!!
one more question very complicated -
if i jump to EAD, what would be my wife status?? i already filed 485 & planning to marry next year & bring spouse on h4.
i dont see EB2 my PD becoming current for next 2-3 years
any inputs are appreciated??

I will be promoted shortly as a Manager. My GC was applied as Programmer Analyst for the same company. When contacted the company attorney informed that it is not a problem, since 6 Months has been completed.

Check with the attorney who has filed for 140. I guess the norm is that attorney also get RN and approval copies.
