    No change in address since 2002..

    Yes. Printed the status of pending with timestamp.. I just checked case tracking website and still shows pending.

    The biggest frustration is we have lost 2 years due to lack of information.

    Would contacting IO using InfoPass be a issue here? My attorney does not want to contact IO, as he is afraid that might confuse the case..

    For me, my attorney's filed successor in interest I-140 after I filed I-485 due to merger. I faced no issues with this process and you can request them to file the same at your end. This did not affect my I-485.

    Thanks for all the replies. Its a very good point that the medical wil get delayed as i have mine scheduled next thursday.

    Will see if there is any work around.

    Also... You can submit your husbands work papers as you are a dependent.

    If you are an engineer then definitely you should have an ecnr but you can have what ever is on your current passport

    I dont know about 31 myself. i will update this posting if i go to the consulate tomorrow.

    Not a word said about this I485 fiasco on the two mostly watched networks (CNN, ABC). Why can't we try to get their attention in this matter. Please suggest ways of getting this published in the above networks.

    The way you track money orders is , after 30 days from the date u gave them out , pull out the Money Order Sequence "Number" at the bottom of the top slip that you have. Give that in along with $5 to your local post office. they would track it for you and give a report.

    CAREFUL though. USPS , when it goes to track the MO, if it has not been cashed, they will give back the value on that MO (say the face value of the MO is $500 , if un-cashed , they give u $500 ). So, the person intended to cash it cannot.

    If cashed they give you the person's ID who cashed it.

    So, wait for a while before you invoke the process.
    Can I inquire from USPS just the status of the money order and not accept any refunds.

    Online application usually warrants a fingerprinting , it's best to apply in paper if that needs to be avoided.

    Job duties and same/similar job functions will be deciding factor. If your GC is for Programmer Analyst and if you become manager as Assets Manager, it will be an issue. If you are promoted as IT manager having significant overlap of job functions, you should be fine.

    if you are like my manager, who forgot how to open IDE and always works on some obsolete excel sheets/ project plans/ outlook, you will have trouble...

    Bottomline, dont leave development even if you become manager.

    Good advice vamsi_poondla. Changing job is always a problem in I-485 stage. Making this more flexible is one of the administrative fixes IV is proposing in the letter to the President. One more reason for everyone to mail that letter, if not mailed already.

    1. How do you know that we are not approving 2004 cases? Just that you didn't got your approval doesn't mean that we are not approving 2004 cases.

    2. There are not that many 2004 cases, so we are approving 2005 and 2006 cases.

    3. We divided cases into 3 boxes : 2004, 2005, 2006. It must be a case that IO's assigned to 2006 are working faster and efficiently.

    4. We received so many 2006 I-485 applications on 07/02/2007. We are just processing by Receive Date.

    5. We made a policy to approve I-485 cases bases on I-140 approval dates. Since we have many cases with old I-140 approval cases that happened to be with earlier priority dates, we are approving them now.

    6. There are so many FBI name check hits on 2004 cases. All name hits will be processed later.

    7. Oops... we sorted all cases that can be approved, by descending order. Sorry!

    8. Time and again we want to approve that we can do anything we want.

    9. All EB2 perm cases are really frustrated EB3 cases that have an older EB3 priority dates. We just wanted to be fair to them.

    10. Yikes! Dog ate all 2004 cases.

    11. Ding, these 2003, 2004 and Early 2005 boxes are under these 2006 boxes that we are too lazy to pick them up.

    Just for a change in topic, do you guys to know good Life insurance company who do not show prejudice between greencard holder and H-1B Holder.
    I just got life insurance through select quote, west coast which coast only 22$ for � million insurance rejected me stating that there is a difference rate of green card holder and Alien.

    I got through Prudential which is costing me 50$.


    Any experience with you folks

    That makes sense. A typical H1B has more things to worry about (maintaining status, keeping job, GC, dealing with rogue employers, attorneys, physicians...) and lower life expectancy :D

    I will be applying for Employment Based green card (EB 1) as I am a multinational Manger . Would also like to include my spouse in the process. He is currently entering the US in July on F1 Visa to enroll into full time masters for 2 years My employer can file for a green card anytime

    I would like to understand the following 1) Can my spouse continue in F1 status and be eligible for internship and OPT until the green card is received 2) Is there any consequences to his present status (F1) because we are going to process his green card? 3) Can he obtain EAD/H1 after his education if the green card is still pending

    We don't want to get into a situation where he has lost his privilages as a F1 student because he has applied for green card.Please advice

    AC 21 doesnt restrict for future employment. Purpose of AC21 is for an employee not to stuck with an employer in case of delay in GC. In this case there is a substantial delay from USCIS and hence you can use AC21.

    I would say EB3 March 2005. Remember, after PERM was put into place in early 2005 more people applied in EB2 than in EB3. I am not an expert, please consult your attorney.

    I guess then she should ask her employer to cancel her H1 (best approach) or least keep documentation of her resignation letter (backup for future RFE). Smart way is to step out of country & come back on parole. Shortcut is to work in some place for a week on I9 like Walmart.

    The employee need not do anything. As long as the employee has a valid status to live, they are fine.

    Definately there is no need to step out of country and come back. There is no need to trigger the change by going through these steps.

    I have changed H1-B several times in the last 11 years i have been in this country. I have invoked AC-21 twice. None of my previous employers revoked my H1-B. I am currently working on EAD. I did not have to leave the country and come back on parole.
